Balwant Singh vs State of Rajasthan and Others

Mohammad Rafiq, J.—This writ petition suffers from gross delay and laches. The petitioner retired from service on 29.06.1996. His grievance is that he ought to have been granted selection scale from the date of initial appointment and if that was done so he would be entitled to third selection scale on completion of 27 years of service, which was not granted to him from the due date.

Firstly, the petitioner has approached this court with enormous delay and secondly the question whether the selection scale should be granted to the petition from the date of initial appointment or from the date of regular appointment, has been authoritatively decided by the Supreme Court in State of Rajasthan and Others Vs. Jagdish Narain Chaturvedi, , wherein it has been held that ad-hoc/temporary employees would be entitled for grant of selection scale from the date of their regular appointment.

In view of the above, I find no case for interference. The writ petition is accordingly dismissed.
