Judgment
R.P. Nagrath, J.—The petition is for quashing of FIR No. 32 dated 14.02.2009 registered under Sections 380, 34 IPC and the consequent proceedings on the basis of written compromise arrived at between the parties. The report has been received from the trial Court after recording statements of the parties along with the original copies of statements of respondent No. 2 and the petitioners. As per the report, respondent No. 2 does not want to proceed with the present case and has no objection if the FIR is quashed. The trial Court has also reported that compromise is voluntary and without any pressure or coercion. There seems to be a family dispute between the parties. Petitioner No. 1 is the father of respondent No. 2. Now they have settled all the issues.
In view of the statements and report of the trial Court and the principles laid down by the Full Bench judgment of this Hon''ble Court in Kulwinder Singh and Others Vs. State of Punjab and Another, , the instant petition is allowed and the FIR and subsequent proceedings conducted on the basis thereof for offences under Sections 380, 34 IPC are quashed. Needless to say that parties shall remain bound in terms of the compromise and by their statements made in Court below.
