M.M.S. Bedi, J.—Petitioner is an accused in a case of trespassing and assault being member of unlawful assembly. It is claimed that a cross-version was also recorded at the instance of Petitioner vide DDR No. 27 dated August 18, 2009 under Sections 452, 324, 323, 148, 149 IPC, Section 326 IPC added later in FIR No. 122 of 2009 registered at Police Station Majitha.

Grievance of the Petitioner is that despite having found the cross-version of the Petitioner correct, challan has not been presented in the cross-case.

Through instant petition, the Petitioner merely seeks to confirm the status report of the cross-version recorded vide DDR No. 27 of August 18, 2009, so that in case cross-version having not been fairly entertained by the police, the Petitioner could avail the alternative remedy available to him in accordance with law. The Petitioner has already submitted a representation to DGP, Punjab and SSP (Rural), Amritsar, vide annexure P-2.

On the asking of the Court, Ms. Gagan Mohini, AAG, Punjab, accepts notice.

This petition is disposed of with a direction to S.S.P., Amritsar Rural, District Amritsar-Respondent No. 3 to ensure that an intimation is sent to the Petitioner regarding the result of the enquiry/ investigation conducted in DDR No. 27 dated August 18, 2009 in FIR No. 122 dated August 17, 2009, registered at Police Station Majitha, District Amritsar (Rural). In case the cross-version has been found to be false, it will be open to the Petitioner to avail any other legal remedy available to him. Necessary steps will be taken within a period of one month after the receipt of a certified copy of this order.
