R.C. Deepak, J.—Heard learned Counsel for the parties at length and perused the record.

A perusal of the first information report would indicate that all the facts relating to the case have been vividly mentioned therein. The weapons assigned to each of the accused have also been disclosed in the first information report. Not only this but the mode and manner in which the occurrence alleged to have taken place has also been described. The medical report appears to have corroborated the injuries caused to the deceased persons. The first information report is the foundation on which the entire structure of the criminal case is built. If the foundation is weak, the entire structure is bound to collapse.

The learned trial court appears to have considered all the facts and circumstances of the case. However, without making any comments on the merits of the judgment of the trial court and after taking into consideration of all the facts and circumstances emerging from the documentary and oral evidence on record, I am of the opinion at this stage and without expressing anything on the merits of the case that the bail application has no substance and is, therefore, rejected.
