Baldev Singh vs State Of Punjab

This habeas corpus petition was listed on receipt of complaint by post from Baldev Singh alias Debu son of Sardar Joginder Singh, alleging that on 4.10.2019, police officails of Police Station Maqboolpura had illegally detained his wife Manjit Kaur and had threatened to implicate her in a false case. The complainant prays that legal action be taken.

Reply by way of affidavit of Shri Jaspreet Singh, PPS, Assistant Commissioner of Police, East, Amritsar, has been filed. It has been stated that a detailed reported has been obtained from SHO Police Station Maqboolpura, Amritsar City with regard to allegations in complaint. The report submitted by SHO Police Station Maqboolpura, Amirtsar City is that on 29.9.2019, ASI Gurinder Singh of Police Station Maqboolpura had received information regarding an altercation going on in Gali No. 12, Maqboolpura, Amritsar City. ASI Gurinder Singh went to spot and found that Rajinder Kaur and her daughters from one side and Manjit Kaur alias Anu (wife of Baldev Singh alias Debu) and her daughter from other side were altercating with each other. ASI Gurinder Singh sent back them to their homes and asked them to come to police station in morning. On 30.9.2019, Rajwinder Kaur submitted an application at Police Station Maqboolpura against complainant Baldev Singh alias Debu and his wife Manjit Kaur alleging that they had given vulgar abuses to her daughters. Manjit Kaur also submitted an application against Rajwinder Kaur and her daughters. With the intervention of respectable persons, matter was compromised between both the parties on 30.9.2019. Rajwinder Kaur did not agree for compromise.

On 1.10.2019, Rajwinder Kaur again submitted an application against Baldev Singh alias Debu and Manjit Kaur. Both parties were called to police station on 2.10.2019. Respectable persons accompanied them took them back home without taking any action and compromise was again effected between them. On 4.10.2019, again an altercation took place between Rajwinder Kaur and Manjit Kaur. They were again called to police station on 8.10.2019 and compromise was arrived at between the parties. The affidavit also mentions that complainant Baldev Singh alias Debu is a criminal type person. As many as 10 cases under the Excise Act and 1 case under NDPS Act is pending against him. It is submitted that Manjit Kaur was not kept in illegal detention on 4.10.2019 at Police Station Maqboolpura.

In view of abovesaid, no further action is called for in the case.
