Baldev Singh vs State of Punjab

Satish Kumar Mittal, J.—Petitioner Baldev Singh apprehending his arrest in a non-bailable offence in case FIR No. 39 dated 5.3.2006

registered under Sections 323/326/34 IPC at Police Station Ajnala, Police District Majitha, has filed this petition u/s 438 Cr.P.C for grant of

anticipatory bail.

I have heard the counsel for the parties and gone through the contents of the FIR.

This order be read in continuation of the earlier order dated August 3, 2006 passed by this Court.

Counsel for the petitioner contends that the petitioner has been falsely implicated by the complainant with the motive to get him suspended. He

further contends that there is a delay of 16 days in lodging the FIR.

Counsel for the petitioner contends that in terms of the aforesaid interim order, the petitioner has joined the investigation. Counsel for the

respondent-State does not dispute this fact. He further states that in this case the challan has already been presented in the Court and the petitioner

is no more required for further investigation.

In view of the above and for the reasons stated in the interim order dated August 3, 2006, the same is made absolute on the same terms and

conditions.

Disposed of accordingly.
