Judgment
Adarsh Kumar Goel, J.—The petitioner has challenged the election of respondent No. 4 from Ward No. 13, Kalianwali, Tehsil and District Sirsa as member of Municipal Committee. The petitioner was a candidate in the Municipal election for Ward No. 13 which was to be held on 2.4.2000 and had filed his nomination accordingly. On the date of election, the petitioner is alleged to have found that symbol allotted to him was not printed against his name. He raised the necessary protest but the election proceeded and respondent No. 4 was declared to be elected.
Learned counsel for the petitioner points out that the symbol allotted to the petitioner was printed against the name of the returned candidate and the symbol allotted to the returned candidate was printed against the name of the petitioner which vitiates the election.
Relevant facts stated in the petition are not disputed. In view of the admitted position, election held has to be held to be vitiated.
Accordingly, this writ petition is allowed, election of respondent No. 4 from Ward No. 13 Kalianwali, Tehsil and District Sirsa, is quashed and fresh election is ordered to be held in accordance with law.
