Judgment
Goutam Bhaduri, J
This is the Third Bail Application filed under Section 439 of the Code of Criminal Procedure for grant of temporary bail to the applicant who has
been arrested on 10.02.2016 in connection with Crime No. 37/2016 registered at Police Station Thana Koni, District Bilaspur (CG) for the offence
punishable under Sections 409, 406, 408, 120 -B of the I.P.C.
Learned counsel for the applicant would submit that the temporary bail has been preferred on the ground that the mother of the applicant has died
on 25.07.2018 for which the rituals are to be carried out in between 03.08.2018 to 06.08.2018 and the applicant being the only son therefore, he is to
go to Allahabad to perform the last rituals, therefore, he may be released on temporary bail for a period of two weeks to complete the rituals.
Learned State counsel was directed to verify the fact whether the death of the mother of the applicant as has been reported has occurred or not. It
is submitted by the learned State counsel, on instructions, that the mother of the applicant has died and he has affirmed the fact of the death of the
mother of the applicant occurred on 25.07.2018.
Considering the same, I am inclined to release the applicant on temporary bail for a period of two weeks from the date of release.
It is directed that the applicant shall be released on temporary bail for a period of two weeks from the date of his release on furnishing a personal
bond in sum of Rs.25,000/- with one surety in the like sum to the satisfaction of the concerned trial Court. It is directed that the applicant shall
surrender immediately after completion of two weeks before the trial Court.
With such direction the bail application stands disposed of.
