Judgment
HEARD learned Lawyers of both sides. By the order dated 20.2.1997, the Forum disposed of the case with a direction to the complainant to pay 50% of the outstanding dues together with further direction that the dispute be referred to CEI, West Bengal, for adjudication. The dispute between the parties is with regard to payment of bill aggregating Rs. 75,063/- pertaining to the period May, 1996, June, 1996, August, 1996. The learned Counsel for the appellant submits that the Forum went wrong in directing payment of 50% of the outstanding dues. He submits that the percentage of payment should be reduced so as to enable the complainant to comply with the order of the Forum. The submission of the learned Counsel for the respondent is that the dispute relates to the payment of bills for May, June and August, 1996 and so far nothing has been paid to the CESC. He submits that the submission of learned Counsel for the appellant deserves outright rejection. Having considered all the aspects of the matter, and the fact that the dispute pertains to the year 1996 we are not inclined to vary the order. The judgment of the Forum below is affirmed. The appeal be disposed of. Order affirmed.
