The present Revision Petition has been filed under Section 21 (b) of the Consumer Protection Act, 1986 against the Order dated 12.09.2019, passed by the Chhattisgarh State Consumer Disputes Redressal Commission, Raipur (hereinafter referred to as “the State Commission”), whereby the State Commission had declined to condone the delay of 56 days in filing the Appeal.

I have heard Ms. Anubha Agrwal, learned Amicus Curiae and Mr. Alok Kumar learned Counsel for the Respondent and perused impugned Order dated 12.09.2019, the grounds taken in the Memo of Revision Petition and the documents filed along with it.

From the facts recorded by the State Commission in the impugned Order dated 12.09.2019, I am of the considered opinion that the Petitioner has sufficiently explained the delay in filing the Appeal and the State Commission ought to have condoned the short delay of 56 days in filing the Appeal. Accordingly the delay in filing the Appeal  before the State Commission is condoned and the Appeal is treated to having been filed within limitation.

The Appeal No. 1 of 2019 is restored to the files of the State Commission and the State Commission is requested to decide the Appeal expeditiously in accordance with law.

The Revision Petition stands disposed of with aforesaid directions.
