The only contention raised by the learned counsel for the petitioner is: Labour Court found the domestic enquiry suffered from illegality and irregularity as it was not in accordance with rules and regulations apart from being violative of principles of natural justice and resultantly, the management was granted an opportunity to prove the charges against the petitioner before the Labour Court, who on appreciation of evidence, found the petitioner guilty of the charges levelled against him.

Petitioner claims wages for the period i.e from the date of his dismissal to the date of passing the award. The petitioner was dismissed from service because of his not performing the official duty by adopting go slow tactics. The ends of justice would be squarely met if half of the back wages from the date of dismissal till the date of passing the award are granted to the petitioner.

With the above modification, award of Labour Court is affirmed and the writ petition stands disposed of accordingly.
