Baladutt Pargai vs State of Uttarakhand and others.

Prayers in the writ petition are as follows:

"i. To issue a writ, order or direction in the nature of Mandamus declaring the mass level transfer as made by the respondents on 31.12.2016 illegal and same shall be quashed and call for the records of the said mass illegal transfer as made from remote areas in Government Intermediate, High School and Junior High Schools.

ii. To issue a writ or order in the nature of Mandamus directing the respondents to make arrangement of teachers in Government Intermediate, High School and Junior High Schools in remote areas where the mass level transfer has been made so that the standards of education shall not be effected."

Since there was concern expressed about the complete vacuum, which will be created by mass transfer, we asked the learned Standing Counsel to get instructions.

Today, when the matter came up, Mr. Pradeep Joshi, learned Standing Counsel for the State of Uttarakhand would submit that impugned order itself has been kept in abeyance until further orders.

We need not allow the petitioner to pursue the matter any further. We record the submission made by learned Standing Counsel and dismiss the writ petition.
