This is an appeal filed by the Bajaj Allianz Insurance Co. Ltd. (hereinafter the Insurer) against the award dated 12.05.2017 passed by the Motor Accident Claims Tribunal (Additional Sessions Judge Anti-Corruption, Jammu[hereinafter the Tribunal]) in file No. 43/Claim titled Pritam Chand Vs. Raj Kumar and ors.
A sum of ₹ 25,000/- on 'No Fault Liability' in terms of section 140 of the Motor Vehicle Act has been awarded by the Tribunal.
Learned counsel for the appellant states that during the pendency of this appeal, the interim award was paid to the claimants in execution proceedings launched by the claimants.
In view of the aforesaid, this petition has been rendered infructuous and accordingly, disposed of.
It shall however, remain open to the appellant to raise all the pleas that have been raised in this appeal in the main claim petition, stated to be pending adjudication before the Tribunal.
Statutory amount of ₹ 12,500/- stated to have been deposited before this Court shall be released in favour of the appellant.
