Judgment

The petitioner had earlier approached this Court and by order dated 10.02.2023 in Crl.M.C. No.839 of 2023, a learned Single Judge of this Court, after taking note of the earlier orders passed by the learned Single Judge, had issued directions to the Indian Embassy at Paris to re-validate the passport of the petitioner for a further period of one year from 01.01.2023. It would be pertinent to note that at the time of passing of the said order, the petitioner was abroad.
After arrival, the petitioner had surrendered his passport before the Judicial First Class Magistrate Court -I, Attingal in terms of the directions issued by this Court.
According to the learned counsel, the petitioner urgently requires to go to Paris to appear for the examination for which purpose, he has preferred Annexure IX application before the learned Magistrate as early as on 24.3.2023. His grievance is that no orders have been passed. The petitioner contends that if urgent orders are not passed the petitioner will not be in a position to appear for the examinations and pursue his education.
Having regard to the facts and circumstances, I am satisfied that the request of the petitioner, as borne out from Annexure IX application ought to have been considered expeditiously by the learned Magistrate.
In that view of the matter, the learned Judicial First Class Magistrate Court -I, Attingal shall take up Annexure IX application and pass orders expeditiously at any rate within a period of three days from the date of production of a copy of this order. While considering the application, the learned Magistrate shall not be burdened by the direction of this Court in Annexure A7 ordering the petitioner to surrender his passport on his return. On the other hand the learned Magistrate shall benevolently consider his application taking note of the observations and directions issued by this Court in O.P. (Crl) No.557/2022, Crl.M.C. No.5581 of 2020 and Crl.M.C. No.839 of 2023.
This Crl. M.C. is disposed of.
