Submissions were made on first bail application preferred under Section 439 of Cr.P.C. in respect of Crime No.404/2020 registered at Police Station

Sendhwa City, District Barwani, for allegedly committing offence under Sections 376, 376(2)(N), 323 and 506 of the IPC. He is in jail since

25/11/2020.

Learned counsel for the applicant submits that charge sheet has been filed and the prosecutrix is major and has no objection regarding grant of bail.

She is present before this Court and she has filed an affidavit before the lower Court. She is represented by learned counsel Shri Amol Pujari who is

present on behalf of Shri Himanshu Thakur, advocate, whose power is placed on record. Learned counsel for the applicant has also submitted that the

incident had occurred 01/11/2020 and report was lodged on 24/11/2020 and looking to the aforesaid factum bail has been sought.

Learned Panel Lawyer for the State was heard.

After duly considering the submission mainly advanced by learned counsel for the applicant and after considering the period of incarceration of the

applicant, without expressing any opinion on merits of the case, the bail application is allowed and it is directed that upon applicant's furnishing a

personal bond to the tune of Rs.50,000/-(Rupees Fifty Thousand Only) with one solvent surety in the like amount to the satisfaction of the trial court,

the applicant shall be released on bail, for his regular appearance before the concerned trial Court on all the dates, as may be fixed in this behalf by the

said Court, till the completion of the trial. He shall also abide by the conditions enumerated under section 437(3) Cr.P.C.
