Heard learned counsel for the petitioner.

Learned counsel for the petitioner has submitted that the petitioner is entitled for regularization from 2001 and his case is squarely covered by judgment of this Court dated 25.01.2017 rendered in the case of Tara Chand vs. Rajasthan State Road Transport Corporation and Ors (S.B. Civil Writ Petition No.8810/2014).

Learned counsel for the petitioner submitted that the petitioner would feel satisfied if the respondents are directed to consider his representation in the light of judgment of Tara Chand (supra).

In view of the aforesaid, the present writ petition is disposed of with a liberty to the petitioner to file a representation, along with a copy of the judgment in the case of Tara Chand (supra) and a certified copy of the order instant within a period of four weeks from today.

In case, a representation is so addressed within the aforesaid period, the competent authority shall consider the same and pass an order in accordance with law, preferably within a period of twelve weeks from the date of receipt of the representation.

It is made clear that aforesaid direction to decide the representation has been issued only with a view to ensure expeditious redressal of petitioner’s grievance. The same may not be construed to be an order to decide the representation in a particular manner.

The stay application also stands disposed of accordingly.
