Baggu Singh and others vs Sheelo Bai

R.P. Nagrath, J.—This petition has been filed for quashing Complaint (Annexure P-2) filed at the instance of the respondent and summoning order dated 28.10.2010 (Annexure P-3). The learned Magistrate issued process against petitioner for offences under Sections 452, 323, 325, 506 IPC. Learned counsel for the petitioners contends that this complaint was result of matrimonial dispute between son of the complainant-respondent and daughter of petitioner No. 1. Decree of divorce was granted in favour of Pipal Singh son of the respondent, which was also challenged in this Court in FAO.

Both the matters were referred to the Mediation Centre and have been settled as per report of the Mediator. This is signed and thumb marked by the parties.

It is also not disputed that the FAO in which challenge was to the grant of divorce decree, has since been withdrawn on the basis of above settlement. The respondent also made a statement before the Mediator to withdraw the instant case. Following the principles laid down by the Full Bench judgment of this Court in Kulwinder Singh and Others Vs. State of Punjab and Another, and approved by the Hon''ble Supreme Court in Gian Singh Vs. State of Punjab and Another, , the instant petition is allowed and Complaint (Annexure P-2) and the subsequent proceedings conducted on the basis thereof, are quashed.
