This special appeal was listed on 18th August, 2023 and it was called twice but none appeared on behalf of the appellant. The matter was postponed for today, however, today also nobody has put in appearance on behalf of the appellant.

The present appeal has been filed by the appellant being aggrieved with the order dated 27.08.2022, whereby the learned Single Judge has dismissed the writ petition filed by the petitioner on the ground of extra-ordinary unexplained delay and latches on the part of the appellant. The appellant applied for the post of Constable (GD), however, his candidature was rejected in the year 2012 and he approached this Court by way of filing the writ petition on 17.05.2019 i.e. after a delay of more than 7 years.

It is noticed that though the writ petition was filed on 17.05.2019, but the defects pointed out by the Registry in the writ petition were not removed and pursuant to the peremptory order passed by this Court, the writ petition came to be dismissed on 10.03.2022, however, later on it was restored on 05.07.2022.

The learned Single Judge is of the opinion that the petitioner has failed to explain delay in approaching this Court within reasonable time, though he was aware about rejection of his candidature in the year 2012 itself.

Having gone through the impugned order and after perusing the writ petition, we are of the opinion that the learned Single Judge has rightly dismissed the writ petition on the ground of extra-ordinary delay and latches. Hence, no case for interference is made out.

The appeal is, therefore, dismissed.
