This appeal has been filed by the appellant against the order dt. 01/07/2013 passed in W.P. No. 1591/2005 (S).

The appellant was subjected to a departmental enquiry in regard to following charges:-

The appellant denied the charges. Thereafter a regular department enquiry was conducted. The charges were found proved. After issuing show cause notice alongwith enquiry report, disciplinary authority imposed punishment of dismissal from service. Against the aforesaid order, an appeal was filed, that was also dismissed. Thereafter, writ petition was filed. Writ Court also dismissed the writ petition after considering the charges.

We have perused the record of the departmental enquiry, orders of the writ Court, disciplinary authority and appellate authority. The writ Court has considered all the aspects of the case and held that the appellant was afforded proper opportunity of hearing and the procedure adopted during departmental enquiry was in accordance with law. Show cause notice was issued to the appellant alongwith the enquiry report. He submitted reply of the same and after considering all the material by the disciplinary authority the order of punishment was passed.

In our opinion, the order passed by the writ Court is in accordance with law. Hence, we do not find any merit in this appeal. It is hereby dismissed.
