T.R. Ramachandran Nair, J.—The petitioner has approached this Court challenging Ext.P6 order issued by the Town Planning Officer whereby his application for giving Corporation number for the building has been rejected. According to the petitioner, he is running a Milma Booth at Thycaud opposite to the Women and Children Hospital.

Various contentions have been raised in the writ petition. In the light of the fact that Ext.P6 is appealable, I am not going into the merits of the matter.

Heard the learned Standing Counsel for the Corporation. The petitioner has got a case that even though Ext.P6 is dated 24/05/2010, the order was not communicated and he had to file an application under the Right to Information Act and only because of the intervention of the Information Officer he could get a copy of the said order. Since it is contended by the learned Standing Counsel for the Corporation that the order is appealable, it is only proper that the petitioner is relegated to the remedy of filing an appeal. Therefore, if an appeal is filed within a period of ten days along with a copy of this Judgment, the same will be entertained by the appellate authority and the matter will be considered on merits after hearing the petitioner within a further period of two months. The direction as above is issued in the peculiar facts and circumstances of the case.

The writ petition is disposed of as above. No costs.
