Since these two bail applications arise out of one and same case record, the same are heard together and disposed of by this common order with the consent of the learned counsels for the parties.
These are bail applications U/S.483 of BNSS by the petitioners for grant of bail in connection with Polasara P.S. Case No. 520 of 2025 arising out of S.T. Case No. 174 of 2025 pending in the Court of learned Addl. District & Sessions Judge, Kodala, Ganjam, for commission of offence punishable U/Ss.191(2)/191(3)/ 103(1)/303(2)/61(2)/190 BNS read with Section 25(1)(a)/27(1) of Arms Act, on the allegation of rioting being armed with deadly weapons and attacking the deceased Rakesh Pradhan by means of lethal weapons, along with co-accused persons including the petitioner Babu Pradhan in prosecution of their common object by entering into conspiracy with each other.
Heard, Mr. Sidhartha Sankar Ray(2), learned counsel for the petitioner in BLAPL No. 2572 of 2026; Mr. Partha Sarathi Das, learned counsel for the petitioners in BLAPL No. 2893 of 2026, Mr. C. Mohanty, learned Addl. PP and Mr. Jyotirmaya Sahoo, learned counsel for the informant in these matters and perused the record.
After having considered the rival submissions upon perusal of record, there appears allegation against the petitioners and others for committing murder of the deceased by entering into conspiracy, but the petitioner-Babu Pradhan is having 08 criminal antecedents including one case U/S.302 of IPC, however, he has not disclosed his criminal antecedents in his bail application. Besides, there is CCTV footage of the occurrence in which the presence of the petitioners Raja Pradhan @ Karanda @ Kanta and Deepak Barada @ Baya is allegedly found at the scene of occurrence.
In such view of the matter and taking into consideration the nature and gravity of the offences as alleged against the petitioners vis-‡-vis the accusations sought to be brought against them and regard being had to the materials placed on record keeping in view the other circumstances on record in entirety including the trial having not yet commenced, but the deceased having sustained 15 injuries on his person, this Court is not inclined to grant bail to any of the petitioners.
Hence, these two bail applications of the petitioners namely Babu Pradhan (BLAPL No. 2572 of 2026); Raja Pradhan @ Karanda @ Kanta and Deepak Barada @ Baya (BLAPL No. 2893 of 2026) stand rejected. Accordingly, the BLAPL stands disposed of. A soft copy of this judgment be immediately transmitted to the Court in seisin over the matter for reference.
