Judgment
The writ petition filed by the petitioner was disposed of after
recording his own statement with the permission to make
representation within the time bound framework & be decided by
the authority and taking note of the satisfaction of the petitioner''s
counsel, the writ petition was decided vide order dt.01.06.2016
with direction to the petitioners to make representation & to be
decided by the authority after assigning due reasons.
In compliance of order of the court, the representation
dt.08.06.2016 (Annex.4) has been made by the petitioner
addressed to the Commissioner, Municipal Corporation, Jaipur.
A bare perusal of the representation dt.08.06.2016 goes to
show that it is completely evasive and does not reveal the bare
facts and there is no cogent evidence on record and what is contended by the petitioner and to be examined/considered by the
authority is completely missing and if this court calls upon the
respondents for non-compliance of order of the court or its
deliberate defiance because of order not being passed on the
representation submitted by the petitioner (Annex.4), it will not be
advisable to proceed in the contempt petition. However, this court
is not satisfied that any contempt has been committed because of
the alleged non-compliance of order of the court, as prayed, on
the representation submitted by the petitioner (Annex.4).
The instant contempt petition accordingly stands dismissed.
However, the petitioner is directed to make a self-contained
representation to the Chief Executive Officer, Municipal
Corporation, Jaipur, in compliance of order of the court
dt.01.06.2016 and if such a representation is made it is expected
from the authority to decide the same keeping in view the
directions of the court.
