This second application under Section 439 of Cr.P.C. has been filed for grant of bail. First application was dismissed by order dated 24.03.2021 passed
in M.Cr.C. No. 16155/2021.
The applicant has been arrested on 02.02.2021 in connection with Crime No.24/2021 registered at Police Station City Kotwali Distt. Morena for
offence under Sections 363, 366, 376(2)((n), 120-B/34 of IPC and Section 3/4 of POCSO Act.
According to the prosecution case, the applicant along with the co-accused kidnapped the minor prosecutrix and took her to Delhi where household
articles were purchased and she was left in the company of child in conflict with law.
Looking to the allegations made against the applicant, this Court is of the considered opinion that period of detention of four months cannot be said to
be reasonable.
Since first bail application was withdrawn with liberty to revive the prayer after undergoing some reasonable period of time, accordingly, counsel for
the applicant seeks permission of this Court to withdraw this application with liberty to revive the prayer after undergoing further period of two
months.
With the aforesaid liberty, the application is dismissed as withdrawn.
