This instant C482 application has been filed by the applicants along with a compounding application for quashing the entire proceedings, charge sheet and cognizance order dated 04.08.2018 under Sections 147, 324, 504 and 506 IPC, passed by learned Judicial Magistrate/IInd Additional Civil Judge, (J.D.), Rudrapur, Udham Singh Nagar in Criminal Case No.7197 of 2018, State Vs. Bablu and others, arising out of F.I.R. No.125 of 2016, Police Station Dineshpur, District Udham Singh Nagar.
A Co-ordinate Bench of this Court vide order dated 19.11.2024 directed the parties to the proceedings to appear before the Secretary, District Legal Services Authority, Udham Singh Nagar on 26.11.2024 at 11:30 A.M., who shall record statements of the parties and verify the statement of the parties filed along with compounding application.
The compliance report of Secretary, District Legal Services Authority, Udham Singh Nagar dated 26.11.2024 is available on record.
From perusal of the compliance report, it is evidently clear that both the parties have entered into compromise and there is no dispute pending between them pursuant to F.I.R. No.125 of 2016 and they have settled their disputes amicably.
The applicants and the respondents were present before the Secretary, District Legal Services Authority, Udham Singh Nagar, who were duly identified by their respective Advocates.
In this view of the matter, all the proceedings of Criminal Case No.7197 of 2018, State Vs. Bablu and others, pending in the Court of learned Judicial Magistrate/IInd Additional Civil Judge, (J.D.), Rudrapur, Udham Singh Nagar, arising out of F.I.R. No.125 of 2016, Police Station Dineshpur, District Udham Singh Nagar are hereby quashed.
