Judgment
Heard on I.A.No.23904/2025. This is the third application under Section 389 of Cr.P.C. for suspension of sentence and grant of bail filed on behalf of sole appellant - Babburaja Singh Gurjar primarily on the ground of period of detention.
The first application was dismissed on merits by order dated 15.03.2024 and second application was dismissed by order dated 22.03.2025.
Since appellant has approached this Court on the ground of period of detention, therefore, the primary question for consideration is as to whether this Court is in a position to hear the matter finally or not?
Accordingly, option was given to the counsel for appellant as to whether he would like to argue the matter finally on 07.01.2026.
It is submitted by Shri Hemant Singh Rana, Advocate that he is not in possession of entire record of trial Court and therefore, office may be directed to scan and upload the said record on ERP and also submitted that he would argue the case finally on 07.01.2026.
Accordingly, office is directed to scan the entire record of trial
Court and upload it on ERP during the course of the day.
List this case on 07.01.2026 for final hearing at motion stage. With the aforesaid observations, I.A.No.23904/2025 is hereby rejected.
