Ram Chand Gupta, J.—The present petition has been filed by petitioner Babbu Singh alias Bhupinder Singh u/s 438 Cr.P.C. seeking anticipatory bail in case FIR No. 174 dated 24.12.2003 registered u/s 420 IPC at Police Station Kahnuwal, District Gurdaspur.

I have heard the learned counsel for the petitioner and have gone through the whole record carefully including the impugned order passed by the learned Additional Sessions Judge, Gurdaspur vide which the bail application of the petitioner was dismissed.

Brief allegations against the petitioner are that he alongwith co-accused cheated the complainant and others to the tune of Rs.16 lacs on the pretext of sending them to Italy. The petitioner-accused introduced the co-accused to the complainant and on the assurance of the petitioner, the amount was paid to the co-accused. However, instead of sending the complainant and other persons to Italy, they were sent to Mascow, where they were detained by the police. Neither the amount was returned, nor the complainant and others persons were sent to Italy. The present FIR is of year 2003 and the proceedings for declaring the petitioner-accused as Proclaimed Offender were also initiated.

It is not such a case in which extra-ordinary relief of anticipatory bail should be granted to the petitioner-accused.

Hence, without expressing any opinion on the merit of the case, the instant petition for anticipatory bail filed by petitioner Babbu Singh alias Bhupinder Singh is, hereby, dismissed being devoid of merit. December 24,
