Baba Tek Singh and Another vs Union of India and Others

Surya Kant, J.—This writ petition purportedly filed in public interest, seeks quashing of orders dated 22.11.2011 and 23.11.2011 (Annexure P-7 to P-10) whereby the Union of India and the other respondents have initiated the process of co-option of members of the Shiromani Gurudwara Parbandhak Committee (SGPC). Since the petitioners themselves participated in the election process for election of the Members of SGPC, we are of the considered view that there exists an element of personal interest, hence they are not entitled to maintain this writ petition in public interest. This Court has already pronounced its decision in Sehajdhari Sikh Federation Vs. Union of India and Others, titled Sehajdhari Sikh Federation v. Union of India & others on 20.12.2011. The impact or implication of the said decision on the election or co-option of members of the SGPC, if any, can be effectively agitated by the petitioners before an appropriate forum in accordance with law.

With aforesaid liberty, the petition is disposed of.
