Judgment
R. Sudhakar, J.—This writ appeal has been filed as against the order of the learned Single Judge passed in W.P(MD) No. 7173 of 2013, dated 02.12.2013. The said writ petition has been filed seeking a writ of Certiorari to call for the records of the respondent by his proceedings No. P/1161/22677/53648 dated 03.04.2013 and quash the same.
Heard both sides and perused the materials available on record.
The order of transfer was passed on 03.04.2013, transferring the appellant to the Divisional Office at Rajkot, Gujarat. He submitted a representation dated 04.04.2013 to the Executive Director (Consumer Sales), Head Office, Mumbai. Since no action has been taken, he has filed the writ petition in W.P(MD) No. 7173 of 2013, wherein interim stay was granted on 23.04.2013 and thereafter, on 02.12.2013, the learned Single Judge dismissed the writ petition, as against which the present writ appeal is filed.
We noticed that the learned Single Judge clearly came to the conclusion that the appellant had been given accommodation for three years in the present post by the respondent authorities. The post of the appellant is transferable in a public sector company and therefore, on administrative ground, he is entitled to be transferred and no mala fide is alleged. Further, the learned Single Judge also came to the conclusion at paragraph 16 of the order that there are some suppression of facts and on that premise, dismissed the writ petition.
We find no good reason to interfere with the order of the learned Single Judge and no plea of mala fide is alleged and the appellant also had the interim benefit and continued for more than ten months and no further indulgence is required in the matter.
Accordingly, the writ appeal is dismissed. Consequently, M.P(MD) No. 1 of 2014 is dismissed and M.P(MD) No. 2 of 2014 is closed. No costs.
