Judgment
ON a complaint instituted by Ajay Kumar Verma, the District Forum -I, UT, Chandigarh, ordered on 17.7.1998 that a sum of Rs. 250/ - shall be payable as damages and Rs.
,000/ - AS costs. Aggrieved against it, the present appeal hAS been attempted. 2. The complainant entrusted to the respondent an envelope containing his application for the competitive examination of Himachal Administrative Service addressed to the Secretary, HPSC on 2.12.1994 and he wAS given an ASsurance that it shall be delivered at Shimla by the evening of next day i.e. 3.12.1994. However, the application wAS delivered on 6.12.1994 after the expiry of the lASt date of receipt which wAS 5.12.1994. The fact that the envelope containing the application wAS not delivered by the evening of 3.12.1994 and it wAS delivered on 6.12.1994 after the expiry of the lASt date, hAS not been challenged here at the time of arguments and even otherwise is very -well established. On behalf of the appellant, it hAS been stressed that the costs Rs. 2,000/ - a warded are excessive. The complainant, an aggrieved person, wAS required to approach the District Forum. The respondent wAS served with the summons after some difficulty and in such cASes, where the appellant had undertaken delivery of letter addressed to the Secretary of a Public Service Commission which are usually time bound, the costs awarded do not call for reduction. The appeal is hereby dismissed. Announced. Appeal dismissed.
