Judgment
The petitioner in this Writ Petition is assailing the order dated 28.11.2023 (Annexure-S) passed by respondent No.2.
Having heard the learned counsel appearing for the parties and on careful consideration of the finding recorded by the authorities would indicate that there is disputed question of title to be adjudicated in the matter. Taking into account the affidavit filed by the petitioners as per Annexure-R4, wherein it is stated that there is discrepancy in the sale deed said to have been placed by the petitioners themselves with regard to establishing right over the property in question, and taking into account the finding recorded by the respondent No.2, that the petitioner therein has to establish right over the property in question before the Civil Court, I am of the view that no interference is called for in this Writ Petition.
Accordingly, the Writ Petition is dismissed.
In view of disposal of the main matter, I.A.2/2026 does not survive for consideration.
