Rule, returnable forthwith. Learned APP waives service of notice of Rule for and on behalf of the respondent-State.
This is an application preferred by the applicant-under trial prisoner seeking temporary bail for a period of 30 days on the ground medical treatment of his wife.
It is reported that the wife of the applicant lives in a joint family and relatives and friends of the applicant can arrange funds and help the applicant during her treatment. It is also reported that the applicant was in judicial custody for the offences punishable under sections 294(b), 506(2), 427 and 384 of the Indian Penal Code, section 135(1) of the G.P. Act. It is submitted by the learned APP that while the applicant was in the judicial custody, he has allegedly committed another offence punishable under sections 3(1)(2), 3(2), 3(4), 3(5) and 4 of the Gujarat Control of Terrorism and Organised Crime Act, 2015.
Noticing the seriousness of the offences, this Court is not inclined to consider his for grant of temporary bail. Hence, this application is rejected. Rule is discharged.
