Petitioner has impugned order dated 22.06.2026, passed by respondent no.3, annexure no.1 to the writ petition, whereby the petitioner was placed under suspension for showing insubordination and indiscipline and committing maar peet in intoxicated condition with his senior and colleagues.

The petitioner being a member of disciplined force is not expected to do so.

Learned counsel for the petitioner submitted that before placing the petitioner under suspension no opportunity of hearing was granted to him.

It is informed by learned State counsel that the charge sheet was issued to the petitioner in a disciplinary enquiry conducted against him by Senior Superintendent of Central Jail Sitarganj, Udham Singh Nagar and he has been called upon to answer the charge sheet.

It is also submitted by learned State counsel that the petitioner showed indiscipline and insubordination with his colleagues and seniors, therefore, he has been placed under suspension.

Having heard learned counsel for the parties and having perused the impugned order this Court is of the view that there is no need to grant the petitioner an opportunity of hearing before passing suspension order against him; however the petitioner was called upon to submit his explanation for his indecent behavior vide letter dated 30.05.2026 and further the enquiry is being conducted and the charge sheet has been issued after appointment of the Enquiry Officer. Hence, this Court is not inclined to interfere in the impugned suspension order dated 22.06.2026.

Accordingly writ petition stands disposed of. The respondents are directed to conclude the enquiry, in accordance with law, within a period of three months from the date of production of certified copy of this order.
