Learned counsel for the petitioner submits that the petitioner, who is working as Lineman with respondent No.2/Corporation, is suffering from 52% permanent disability and in terms of Rule 3.27 of the Punjab Civil Services Rules, Volume I Part-I, if an employee is suffering from any of the disabilities not less than 40%, he/she shall retire at the age of 60 years instead of 58 years. A copy of the disability certificate is at Annexure P-1. He also submits that although order (Annexure P-6) mentions that the petitioner would be relieved on 31.05.2022 after completing 58 years, he has not been relieved.
Issue notice to the respondents.
At the asking of the Court, Mr. T.P.S. Chawla, DAG, Punjab, accepts notice on behalf of respondent No.1.
Mr. Gauravdeep Singh Dhaliwal, Advocate has put in appearance on behalf of respondents No.2 and 3.
Heard.
The petition is disposed of with a direction to respondent No.3 to consider and decide the case of the petitioner for retirement at the age of 60 years in view of his disability certificate (Annexure P-1) and the relevant instructions/rules. Respondent No.3 may get the certificate verified and take a final decision in the matter within fifteen days from now.
