Ayata Ram vs State of Himachal Pradesh and Others

Kurian Joseph, C.J.—The Writ Petition is filed with the following prayer:

i. That the respondents may be ordered to grant the work-charged status to the applicant w.e.f. 1.1.2000 with all the benefits incidental thereof such as arrears of pay and seniority in the cadre of Beldar and the Clause 7 of the appointment letter may be struck down.

Learned Counsel for the petitioner submits that identical matter was considered by this Court leading to judgment in CWP(T) No. 10220 of 2008, Smt. Phool Maya v. The State of Himachal Pradesh and Ors. In case the petitioner is similarly situated, he shall also be entitled to the benefits flowing out of the said judgment.

Therefore, this Writ Petition is disposed of directing the first respondent to look into the petitioner herein also in the light of the judgment referred to above subject to its finality and take appropriate action in accordance with law, without discriminating the petitioner, within a period of three months from the date of production of a copy of this judgment and also a copy of the judgment referred to above. The benefits, if any, flowing out of the consideration as above, shall also be disbursed within another one month.
