A.K. Rajan, J.—The writ petition is filed for issue of writ of certiorari to call for the records on the file of the Assistant Engineer

(Distribution) Rural T.N.E.B Sankarankoil in xxxx tamil typed xxxxx dated 11.8.1995 and quash the same.

The writ petitioner is a holder of service connection of electricity in his factory under the name and Style of Raja Enterprises, Vadikottai in

Sankarankoil Taluk. On 5.5.1994 a notice was issued alleging that certain mal-practices were found during inspection of the service connection.

Therefore, the authority issued a notice dated 25.5.1995 directing the petitioner to pay a sum of Rs.25,16,270/ as penalty in accordance with law.

Challenging this demand, the present writ petition has been filed.

Pending the writ petition, the petitioner was permitted to file an appeal before the respondent Board on condition that the petitioner pays a sum

of Rs.10,000/- . Now it is stated that the appeal has been filed by the petitioner herein and it is still pending. In view of the pendency of the appeal,

this writ petition has become infructuous. The petitioner has to work out his remedy only in the appeal.

In the result, the writ petition is dismissed as infructuous. No costs.
