Learned counsel for the petitioner prays for time as the arguing counsel Mr. Vishal Kumar Tiwary is not available today. However, the learned counsel appearing on behalf of the petitioner has placed the case of the petitioner and he submits that the action of the respondents is contrary to the direction issued by the Ministry of Finance.
The learned counsel appearing on behalf of the respondents has submitted that the matter of compassionate appointment is to be guided by the scheme of the compassionate appointment and as per the scheme of the compassionate appointment, there is a clear bar of entitlement of both ex-gratia payment and compassionate appointment. He submits that the mother of the petitioner has already received ex-gratia payment amounting to Rs. Six lacs and the petitioner was a witness to such payment and no compassionate appointment can be extended to the petitioner.
However, since the petitioner is seeking adjournment on account of non-availability of arguing counsel Mr. Vishal Kumar Tiwary, matter is adjourned and is directed to be posted on 14.07.2022 for further hearing under the same heading.
Let this matter be treated as part heard.
It is made clear that no further adjournment shall be granted on the next date.
