Judgment
TEJINDER SINGH DHINDSA, J. (ORAL).
Petitioner seeks benefit of regular bail pending trial in case F.I.R. No.22, dated 17.03.2016, under Sections 457/380/436 IPC, registered at Police
Station Jathlana, District Yamuna Nagar.
FIR came to be registered on the statement of Parveen Kumar working as Manager in the Yamuna Central Cooperative Bank, Branch Sandhali.
Allegations are that on the intervening night of 16/17-03.2016, some unknown persons have committed theft of two computer LCDs and two CPUs
and thereafter put on fire the bank premises and on account of which a number of articles lying within the premises have suffered damage and have
been burnt.
Present petitioner is sought to be implicated on the statement of co-accused, namely, Partap Singh and who was in custody in a different FIR.
Date of arrest of the petitioner is 03.08.2017.
Investigation in the case is complete and even challan has been presented.
Trial is at the very initial stage and would take time to conclude.
Co-accused, Partap Singh and on whose disclosure statement, the present petitioner was implicated has been granted concession of bail by this Court
vide order dated 15.03.2018 in CRM-M-46586-2017.
Without making any observations on merit, petitioner is held entitled to the benefit of bail.
Petitioner be enlarged on bail subject to satisfaction of Trial Court/Duty Magistrate concerned provided that he is not required in custody in any other
case.
Petition disposed of.
