Judgment
Dinesh Mehta, J
The present bail application has been filed by the applicant under Section 439 of the Cr.P.C. in connection with FIR No.277/2023, registered at Police Station CPS ACB, District Jaipur for the offence under Section 7 of the Prevention of Corruption Act, 1988.
Learned counsel for the applicant submitted that the charge-sheet has been filed alleging the offence under the Prevention of Corruption Act, 1988 and neither any investigation nor any recovery is to be made from the present applicant and thus, prayed that the present applicant who is behind the bars since 19.10.2023, be enlarged on bail.
Learned Public Prosecutor vehemently opposed the bail application by contending that the applicant was nabbed red-handed taking bribe of huge amount of Rs.50,000/- and therefore, no indulgence be granted to him.
Heard learned counsel for the parties and perused the material available on record.
Considering that the charge-sheet has been filed and neither any investigation nor any recovery remains pending from the present applicant, this Court deems it just and proper to enlarge the present applicant bail.
The present bail application is thus, allowed. It is ordered that applicant Avesh Mohammad S/o Shri Sabir Mohammad arrested in connection with FIR No.277/2023, registered at Police Station CPS ACB, District Jaipur shall be released on bail on his furnishing personal bond in the sum of Rs.1,00,000/- and two sureties of Rs.50,000/- each to the satisfaction of the learned trial Court/link Court.
Applicant shall be required to appear before the trial Court on all dates of hearing and as and when called upon to do so.
