The instant writ petition has been filed for payment of admitted dues of Rs. 14,79,028/- for completion of construction of Arts building at Deoghar College, Deoghar by the petitioner.

Earlier W.P. (C) No. 377 of 2021 was filed by the petitioner which was disposed of vide order dated 23.03.2021 with direction to the petitioner to file representation before respondent no. 6 for payment of admitted dues.

In pursuance of compliance to the direction of this Court, a reasoned order was passed on 24.02.2023 by the Managing Director, Jharkhand State Building Construction Corporation Limited, wherein it was admitted that there was a due of Rs.14,79,028/-.

It is argued by learned counsel on behalf of the petitioner that the work was finally executed on 10.03.2019 and despite lapse of more than six years, final admitted dues has not been paid.

Learned counsel appearing on behalf of the respondent no. 4 to 7 submits that Higher Technical Education and Skill Development Department, Government of Jharkhand (Respondent No. 3) was moved seeking allotment to make payment, but since the allotment has not been received, therefore, the payment could not be made.

Under the circumstance, respondent no. 3- Secretary, Higher Technical Education and Skill Development Department is directed to allot the fund to respondent no. 4- Managing Director, Building Construction Corporation Limited for disbursing the pending dues of the petitioner, if there is no other legal impediment. The allotment will be made within four weeks from the date of this order. If the allotment is not made within the stipulated time, Higher Technical Education and Skill Development Department will be liable to pay interest @ 9% per annum from the date of completion of the work.

Accordingly, this writ petition stands disposed of.
