Judgment
Mr. Kunal P. Vaishnav, Learned Counsel is present for the Applicant/Operational Creditor (OC).
Mr. B. Agarwal, IRP is present in person.
IA (IBC)/47/GB/2026 under Section 12A and Section 60(5) of the Insolvency and Bankruptcy Code, 2016, read with Rule 11 of the NCLT Rules, 2016, has been filed by the IRP seeking withdrawal of the main petition.
The record reflects that the Committee of Creditors (CoC) has approved the withdrawal with (100%) voting share.
In view of the above, the IA deserves to be allowed and the same is hereby allowed and disposed off.
Accordingly, the main CP (IB)/5/GB/2025 stands disposed off as withdrawn.
Mr. B. Agarwal, IRP is present in person.
Learned Counsel for the Applicant submits that the present IA has been filed for the confirmation of appointment of Mr. Bishal Agarwal as the Resolution Professional (RP) of the CD in accordance with Section 22 of IBC, 2016.
Learned Counsel for the Applicant further submits that since the main petition has been withdrawn, the present IA has become infructuous.
Accordingly, the present IA is held to be infructuous and stands disposed off.
