The petitioner seeks quashing of complaint No.NACT/355/2022 dated 12.8.2022 under Sections 138/142 of Negotiable Instruments Act titled ‘Sandeep Singh Versus Atma Singh (Annexure P-1) as well as summoning order dated 20.10.2022 (Annexure P-2) passed by learned Judicial Magistrate 1st Class, Mansa and also order dated 16.3.2024 (Annexure P-10) passed by learned Judicial Magistrate 1st Class, Mansa vide which he has been declared a proclaimed offender.

Today, at the very outset, learned counsel for the petitioner submitted that he has instructions to the effect that the petitioner wishes to amicably resolve the matter on some reasonable terms and that, as such, he may be permitted to withdraw the present petition, at this stage, with liberty to surrender before the Trial Court and to move an application for grant of regular bail.

Having regard to the aforesaid submission and the fact that the matter arises out of a complaint under Section 138 of Negotiable Instruments Act, the instant petition is hereby dismissed as withdrawn with liberty to the petitioner to appear before the Trial Court within a period of 10 days from today and to move an application for grant of regular bail. In case, any such application is filed on behalf of the petitioner in the forenoon of the day, the learned trial Court shall endeavour to dispose of the same expeditiously preferably on the same day itself.
