Judgment
(1) The petitioner-company has approached this Court seeking appropriate direction to the respondent â€" Municipal Board, Sagwada, before whom
an application seeking permission to install a mobile tower has been filed by it on 22.10.2018.
(2) Learned counsel raised a grievance that though the Government order dated 06.02.2017 so also the decision dated 17.09.2019 issued by the
Director of the Local Bodies enjoin upon the competent authority to decide the application within a period of two months, yet the respondent â€
Board has not decided the same.
(3) It is stated by learned counsel that petitioner â€" company has been pursuing hard for grant of permission and has even sent a notice dated
16.05.2019, yet no heed has been paid by the Municipal Board to petitioner’s requests.
(4) Having regard to the facts noticed above, the present writ petition is disposed of with a direction to the Executive Officer of the Municipal Board,
Sagwada to decide petitioner’s application (filed on 22.10.2018), within a period of one month from placing a certified copy of the order instant, in
accordance with law.
(5) The stay application also stands disposed of accordingly.
(6) It is made clear that aforesaid direction to decide the representation has been issued only with a view to ensure expeditious redressal of
petitioners’ grievance. The same may not be construed to be an order to decide the representation in a particular manner.
