Atam Parkash vs Sonia and Others

Swatanter Kumar, J.—Ms. Sonia as well as her father Subhash Chander who is the informant in this case are present in Court. It is stated by Ms. Sonia that she was married to petitioner Atam Parakash first but she could not put along together and their marriage was dissolved by a decree of divorce by the learned District Judge, Ferozepur, on 15.6.1996 by mutual consent. Thereafter she claims to have re-married to one Mr. Krishan Dhamija and is happily living with him now. She has stated that she as well as her father are not interested in prosecuting this case any further and wishes to withdraw their complaint/FIR against accused Atam Parkash and Surinder Kumar.

Though the allegations made in the F.I.R. are somewhat serious but as the informant as well as the alleged victim do not wish to stand by their statements and wish to withdraw the same and in fact have already settled their matrimonial disputes amicably by getting a decree by mutual consent on such terms and conditions as were acceptable to both of them, they have jointly prayed for quashing of the F.I.R.

I find it in the interest of justice and expedient to quash the FIR so that the parties may live amicably without any hindrance from each other so that the girl does not face any difficulties in her subsequent matrimonial home.

For the reasons afore stated and in view of the judgment of the Supreme Court in the case of Mahesh Chand v. State of Rajasthan 1988(1) AICLR 831 (SC), I hereby quash F.I.R. No. 126 dated 4.1.1995, under Sections 498-A/307/406/354/34, IPC of Police Station, City Ferozepur and the petitioner/accused shall stand discharged. This petition is disposed of.
