Exts.P3 and P4 applications filed by the petitioner in Form No.5 and Form No.6 of the Kerala Conservation of Paddy land and Wetland Rules
seeking exclusion of the property from the data bank and for change of nature, are pending consideration before the first respondent. According to the
petitioner, the property in question is a garden land and the property has been erroneously included in the data bank published under the Act. It is for
the first respondent to consider the applications on its merits and pass appropriate orders.
Without expressing anything on merits, the writ petition is disposed of directing the first respondent to initially consider Ext.P3 application (Form
No.5) on obtaining and verifying relevant materials. If orders are passed excluding the property from the data bank, then Ext.P4 application in Form
No.6 shall be taken up, considered and appropriate orders passed. Let the proceedings be completed within a period of five months from the date of
receipt of a copy of this judgment.
