Learned Counsel for Appellant would submit that the delay in preferring the appeal was not intentional rather the Learned Counsel could not appear when the matter was called on. Application is moved on 6.8.2026.

Having considered the submission, I find that the ground sufficient to condone the delay. Accordingly, Misc. Application Diary No. 857 of 2026, along with I.A. 362 of 2026, is allowed.

Appeal Diary No. 522 of 2026 is restored to its original file and number.
