This matter is taken up by video conferencing mode.
This is an application under Sec.439 Cr.P.C. for bail and the offences alleged are under Secs.302/506/120-B/34, I.P.C.
Heard learned counsel for the Petitioner as well as learned A.S.C. for the State-Opposite Party.
It is submitted by learned counsel for the Petitioner that the Petitioner is a woman and inside custody since 2.9.2020. It is further submitted that as
per the statement of the eye-witnesses, the fatal blow was given by means of an axe by co-accused Okil Samal and the axe was supplied by co-
accused Anusuya Samal. In respect of other co-accused persons, the allegations are omnibus in nature.
After hearing learned A.S.C. for the State-Opposite Party and considering the statement of the eye-witnesses, it is directed to release the Petitioner
on bail in connection with Chaudwar P.S. Case No.405/2020 corresponding to S.T. Case No.778/2020 on such terms and conditions to be fixed by the
learned J.M.F.C.(R), Cuttack or the court in seisin over the matter as he deems just and proper including the condition that the Petitioner shall not be
involved in any other offence while on bail and shall maintain peace in the village.
BLAPL is accordingly disposed of.
