Judgment

Heard Dr. N. Mozika, learned DSGI who has submitted that as directed by this Court, the copies of the proceedings of the Security Force Court of the Border Security Force (BSF) is produced before this Court and may be handed over to the Court as and when called for. However, as far as the prayer of the petitioner for inspection of the same, the learned DSGI has submitted that there is a clear provision under the rules, particularly Rule 129 of BSF Rules which provides for supply of copies of such proceedings to the petitioner if the same is applied for.
Interjecting in the matter, the learned counsel for the petitioner has submitted that admittedly, the petitioner has not yet applied for copies of the same and has made a prayer to this Court that he may be allowed to apply for such copies in accordance with Rule 129.
Though it is incumbent upon the petitioner to assert his rights, however, taking into account the issue in hand and for ends of justice, the Court would allow the prayer of the petitioner at this juncture. The petitioner is to apply for the said copies and the respondent authorities to allow such application and to hand over any copies which are entitled to by the petitioner as per rules.
The exercise is to be done within a period of 2(two) weeks.
