Judgment
The applicant, Mr. Ashwini Saini, General Secretary, Sunder Nagar Progressive Development Forum (R), 10 Indira Market BBMB Colony, Sundernagar, Himachal Pradesh has sent the present letter petition by e-mail on 15.05.2023 for issuance of directions for abatement of pollution caused by the Contractor constructing four lane National Highway.
The applicant has appeared and submitted that Contractor was violating the environmental norms earlier but subsequently tankers were deployed for sprinkling of water and after onset of monsoon season, there is no dust pollution and the applicant seeks permission to withdraw the application.
In view of the averments made in the application, nature of relief sought and alleged past violations, we consider it appropriate that factual verification be made and appropriate remedial action be taken by the concerned authorities.
Accordingly, Member Secretary, Himachal Pradesh Pollution Control Board (HPPCB) is directed to look into the grievances made in the application, verify the factual position, impose and recover appropriate environmental compensation for past violations by following due process of law and take other requisite remedial measures including sprinkling of water to suppress dust, use of treated waste water instead of fresh water and raising of appropriate plantation and the application is disposed of accordingly.
A copy of this order, along with a copy of the application and documents attached with the same, be forwarded to the Member Secretary, HPPCB by e-mail for requisite compliance.
