Judgment

Learned counsel for the petitioner submits that the petitioner had appeared in CET examination, 2020 and was allotted a seat in Engineering Discipline. However, the petitioner could not take admission as his grand mother expired. It is further submitted that the bar contained under Rule 15(5) of the Karnataka Selection of Candidates for admission to Government Seats in Professional Educational Institutions Rules, 2006 does not apply to the case of the petitioner as the petitioner was not admitted to the seat to which he was allotted. It is also submitted that the petitioner be permitted to choose the seat before the same is surrendered to the colleges.
On the other hand, Mr.N.K.Ramesh, learned counsel for respondent No.2 submits that as a special case, the petitioner be permitted to opt for a seat.
In view of the aforesaid submissions and taking into account the fact that the petitioner was not admitted in the college in which he was allotted a seat, it is directed that the petitioner shall be permitted to opt a seat in the Engineering Course. It is made clear that this order shall not be treated as precedent.
Accordingly, the Writ Petition is disposed of.
