Judgment

Heard Mr. C.S. Sinha, learned counsel appearing for the petitioner. Also heard Mr. D. Sarma, learned Addl. GA appearing for the respondents-State.
By means of filing the instant writ petition, the petitioner has prayed for consideration of his promotion to the post of TES Grade IV (Civil).
It is the case of the petitioner that he is a differently-abled person and is entitled to get promotion to the next higher grade under the quota for disabled persons and 4% of posts are reserved for PH Category.
Without entering into the details of the petition, it is an admitted position that pursuant to notification dated 31.12.2021, the petitioner was promoted to the post of TES Grade V(A) (Civil) as he belongs to UR (PH Locomotor).
Under TES Service Rules, an engineer will be considered for promotion to Grade IV after completion of 3(three) years of minimum service in the post of Grade V(A). From the notification dated 31.12.2021, it is crystal clear that the petitioner has not completed 3(three) years of minimum service in the post of TES Grade V(A) till today.
In view of this, the petitioner has not come within the zone of consideration for promotion to the post of TES Grade IV. However, it is made clear that the promotion of the petitioner shall be considered after completion of 3(three) years of service in the post of TES Grade V(A) as and when the respondents shall initiate the process of promotion of the Engineers holding the post of TES Grade V(A).
With the aforesaid observations and directions, the instant writ petition stands dismissed.
